Terms of Service

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off Period: The period within which the consumer may exercise their right of withdrawal.

  • Consumer: A natural person not acting in the exercise of a profession or business who enters into a distance agreement with the Entrepreneur.

  • Day: Calendar day.

  • Term Transaction: A distance agreement relating to a series of products and/or services, where the delivery and/or purchase obligation is spread over time.

  • Durable Medium: Any tool that enables the consumer or Entrepreneur to store information addressed personally to them in a way that allows for future consultation and unaltered reproduction of the stored information.

  • Right of Withdrawal: The option for the consumer to cancel the distance agreement within the cooling-off period.

  • Entrepreneur: The natural or legal person offering products and/or services to consumers at a distance.

  • Distance Agreement: An agreement whereby, within the framework of a system organized by the Entrepreneur for the distance sale of products and/or services, exclusive use is made of one or more techniques for distance communication up to and including the conclusion of the agreement.

  • Technique for Distance Communication: A means that can be used to conclude an agreement without the consumer and Entrepreneur being in the same room at the same time.

Article 2 – Applicability

These Terms and Conditions apply to every offer made by the Entrepreneur and to every distance agreement and order concluded between the Entrepreneur and the Consumer. Before the distance agreement is concluded, the text of these Terms and Conditions will be made available to the Consumer. If this is not reasonably possible, it will be indicated before the agreement is concluded that the terms can be inspected at the Entrepreneur's premises and will be sent free of charge as soon as possible upon request.

Article 3 – The Offer

If an offer has a limited duration or is subject to conditions, this will be explicitly stated. The Entrepreneur is entitled to change or adjust the offer at any time. The offer contains a complete and accurate description of the products/services provided. Images used are a truthful representation of the products. Obvious mistakes or errors in the offer do not bind the Entrepreneur. Note on Pricing: Prices do not include customs clearance fees or import VAT. These additional costs are the responsibility and risk of the customer. The courier service will collect these fees upon delivery.

Article 4 – The Agreement

The agreement is concluded at the moment the Consumer accepts the offer and meets the established conditions. The Entrepreneur will immediately confirm receipt of acceptance via email. Until this confirmation is sent, the Consumer may dissolve the agreement.

Article 5 – Right of Withdrawal (Returns)

Upon purchasing products, the Consumer has the option to dissolve the agreement without giving a reason for a period of 30 days. This period begins the day after receipt of the product. During this period, the Consumer must handle the product and packaging with care. If the Right of Withdrawal is exercised, the product must be returned with all supplied accessories and—if reasonably possible—in its original state and packaging.

Article 6 – Costs in Case of Withdrawal

If the Consumer exercises their right of withdrawal, the costs of returning the products are for the Consumer's account. The Entrepreneur will refund the purchase amount as soon as possible, but no later than 30 days after the return, provided the product has been received or conclusive proof of return is provided.

Article 7 – Exclusion of the Right of Withdrawal

The Entrepreneur can exclude the right of withdrawal for specific products, such as:

  • Custom-made or personalized items.

  • Perishable goods.

  • Sealed audio, video, or software where the seal has been broken.

  • Hygienic products where the seal has been broken.

Article 8 – Pricing

Prices will not be increased during the validity period stated in the offer, except for changes due to VAT rate adjustments. All prices are subject to printing and typographical errors. The Entrepreneur is not obliged to deliver the product at an incorrect price resulting from such errors.

Article 10 – Conformity and Warranty

The Entrepreneur guarantees that the products meet the agreement and reasonable requirements of reliability. Any defects or incorrectly delivered products must be reported in writing within 30 days of delivery.

Article 11 – Delivery and Execution

The Entrepreneur will execute accepted orders with convenient speed, but no later than 30 days, unless a longer period is agreed upon. If delivery is delayed, the Consumer has the right to dissolve the agreement at no cost.

Article 12 – Payments

Unless otherwise agreed, amounts owed by the Consumer must be paid within 7 business days after the start of the cooling-off period. The Consumer is obliged to report any inaccuracies in payment data immediately.

Article 13 – Complaints Procedure

Complaints about the execution of the agreement must be submitted fully and clearly described within 7 days after the Consumer discovers the defects.

Article 14 – Disputes

Agreements between the Entrepreneur and the Consumer are governed exclusively by Dutch law, even if the Consumer resides abroad.

Article 15 – CESOP

In accordance with measures introduced in 2024 regarding the implementation of the Central Electronic System of Payment information (CESOP), payment service providers may register data in the European CESOP system to prevent tax fraud.
